Cooking Classes Terms and Conditions

PLANT B LIFE - COOKING CLASSES
TERMS AND CONDITIONS 
  1. Definitions and interpretation
    • “Plant B Life” means Plant B Life Pty Ltd ACN 632 489 500.
    • “Social Media” means any of the following platforms:
      • Facebook;
      • Twitter;
      • YouTube;
      • LinkedIn;
      • Pinterest;
      • Snapchat;
      • Instagram; or
      • Any other similar social media platform.
    • “You” means any:
      • Guests and/or individuals; or
      • Other person that attends and/or participates in a Plant B Life cooking class.
  1. General Requirements to participate in a cooking class
    • By purchasing a ticket to participate in a Plant B Life cooking class, You acknowledge to agree and accept these Terms &Conditions.
  2. Dietary Requirements
    • You are responsible for expressly disclosing any dietary requirements in writing to Plant B Life, including but not limited to any food allergies, in tolerances, restrictions or cultural needs, at least seven (7) days prior to a Plant B cooking class.
    • A person with food allergies must:
      • Disclose to Plant B Life’s agents or employees if they have been prescribed an EpiPen; and
      • Bring an in-date EpiPen to the cooking class.
  1. Refunds
    • Plant B Life does not offer refunds, transfers or credit notes:
      • When You give‘change of mind’ reasons, including illness or injury;
      • When You fail to attend a class for any other reason; or
      • If Plant B Life refuses to allow You to participate in a Plant B Life cooking class due to Your failure to read and/or abide by these Terms & Conditions.
    • If Plant B Life needs to cancel, reschedule or relocate a cooking class:
      • You will be notified as soon as possible; and
      • In the event a class is rescheduled or relocated, and You are unable to attend as a result, Plant B Life will provide You with a full refund, or (if nominated in writing by You) a credit note to attend another Plant B Life cooking class at a later more suitable date.
  1. Discretion
    • Plant B Life reserves the right to terminate Your participation either prior or during a cooking class if You:
      • Do not meet the requirements as set out in these Terms & Conditions;
      • Are behaving in a manner that Plant B Life’s agents or employees consider as unsafe or inappropriate;
      • Fail to adhere to these Terms & Conditions; or
      • Dietary requirements as per clause 3 of these Terms & Conditions are not able to be confidently and adequately met.
  1. Waiver
    • You irrevocably acknowledge and accept that in order to participate and/or attend a Plant B Life cooking class, to the extent as permitted or required by law, You hereby waive, release, covenant not to sue, and discharge Plant B Life from:
      • Any and all claims, actions, suits, demands, losses and other liabilities arising from and/or in relation to the loss of property, any death physical or mental injury resulting from or in connection with Your attendance and/or participation in the Plant B Life cooking class, including but not limited to any allergic reaction; or
      • Any ordinary negligence of Plant B Life that You may have arising out of Your attendance and/or participation in a Plant B Life cooking class.
  1. Liability and Indemnity
    • You irrevocably release and at all times indemnify and keeps indemnifying (following Your attendance and/or participation in a Plant B Life cooking class) Plant B Life and its officers, employees, service providers and agents (referred to herein after as “Those Indemnified”) from and against all actions, claims, proceedings and demands, including those brought by third parties, which may be brought against Those Indemnified, whether on their own or jointly with You and whether at common law, under tort, in equity, pursuant to statute or otherwise, in respect of any loss, death, injury, illness or damage (whether personal or property and whether direct or consequential, including consequential financial loss), arising directly or indirectly out of or in connection with the attendance and/or participation in a Plant B Life cooking class.
    • The indemnity will extend to all costs, including reasonable legal costs, damages and expenses incurred by Plant B Life.
    • Despite any other term described in the Terms & Conditions and to the maximum extent as so permitted by law, Plant B Life will not bear any liability to You for any consequential loss including loss of profits, loss of business opportunities or loss of goodwill howsoever arising.

Limitation of Liability

  • If any warranty, term or condition in the Terms & Conditions cannot at law be excluded or avoided then, to the extent as permitted or required by law, Plant B Life’s liability is limited to:
    • The cost of the cooking class to the value that You had paid; or
    • Supplying the cooking class to You again.
  1. Privacy Terms & Conditions
    • Except as set out in the Terms & Conditions, Plant B Life does not disclose or sell Your personal information to any third parties.
    • Plant B Life may disclose Your personal information to third-party services providers who perform services on their behalf. For example, Plant B Life may hire others to handle the processing of payments, to provide data storage, to host websites, to assist in marketing, or to conduct audits. Those third-party services provided:
      • Shall be permitted to obtain only the personal information they need to provide such services;
      • Must protect Your information; and
      • Shall be prohibited from using it for any other purpose.
    • In certain circumstances, some information about Plant B Life’s customers, including personal information, may be disclosed due to:
      • A merger, acquisition, or sale of the business and/or its assets;
      • In the event of insolvency, bankruptcy, or receivership; or
      • As required or permitted to do so by law.
  1. Intellectual Property
    • All intellectual property that exists or arises from the Plant B Life’s cooking classes, including but not limited to any digital products, resource material, videos and online content remain the property of Plant B Life and are subject to copyright protection.
  2. Social Media
    • You grant Plant B Life a non-exclusive perpetual license for Plant B Life to freely use, edit, alter, reproduce, publish and/or distribute any material recorded, produced or obtained in a Plant B Life cooking class.
    • Plant B Life:
      • Reserves the right to post content, including photos or videos, on Social Media, unless You indicate that You do not agree to such at or before the cooking class; and
      • Disclaims any liability associated with the use of such material in this clause 11, or for any misuse of any content which may occur through a Social Media platform beyond the reasonable control of Plant B Life.
  1. General
    • These Terms & Conditions constitute the entire agreement between the parties and unless specifically stated within the Terms & Conditions, no other representation, document or statement shall be considered part of the Agreement.
    • You must follow all reasonable directions of Plant B Life during the course of the cooking class.
    • Plant B Life reserves the right to amend these Terms & Conditions from time to time.
    • Alcohol is permitted to be consumed only within the premises where the Plant B Life cooking class is to take place, and at the direction of Plant B Life agents or employees, and in accordance with the relevant liquor licensing laws.
    • Plant B Life does not in any way promote or condone driving a transportation vehicle during or after the consumption of alcohol, and encourages participants to make alternative travel arrangements should they choose to consume alcohol during a Plant B Life cooking class.
  2. Declaration
    • You acknowledge, that You have read and understood the Terms & Conditions and declare that You agree to be bound by it.
